"Assault Weapon" Myths

This post is meant to inform the public about terminology commonly used by the media and anti-gun advocates to criminalize certain types of firearms.

1. Automatic Weapons

Some media outlets talk of the need to ban automatic weapons. These weapons continue to fire after the trigger is pulled until the operator either: releases the trigger or runs out of ammunition. Key words you may hear when speaking about these weapons are "high rate of fire" or "capable of firing hundreds of rounds a minute".

Citizens in good standing can own these weapons provided the pay a special tax, meet the background check criteria and have them registered with the government.

In fact, Senator Feinstein's proposed Assault Wepaon Ban will restrict Semi-automatic weapons (Only one bullet fired per trigger pull) more than fully automatic weapons!!


2. Assault Weapon

The definition of an assault weapon will soon be made in the upcoming legislation for an Assault Weapons Ban. Before this, lets break it down into it root words based on definitions from the free dictionary:

weap·on (wpn)

n.
1. An instrument of attack or defense in combat, as a gun, missile, or sword.
2. Zoology A part or organ, such as a claw or stinger, used by an animal in attack or defense.
3. A means used to defend against or defeat another: Logic was her weapon.
 as·sault  (-sôlt)
n.
1. A violent physical or verbal attack.
2.
a. A military attack, such as one launched against a fortified area or place.
b. The concluding stage of an attack in which close combat occurs with the enemy.
3. Law
a. An unlawful threat or attempt to do bodily injury to another.
b. The act or an instance of unlawfully threatening or attempting to injure another.
4.
a. Law Sexual assault.
b. The crime of rape.
You will notice that something becomes a weapon only when it is used in an attack. An Assault weapon would be a weapon used during an assault, or violent attack. A knife used during the commission of a rape would be an assault weapon, as would be a baseball bat during a domestic dispute.

3. High-powered rifle
I have heard the AR-15 described as a "high-powered rifle" in recent weeks. We will generalize a rifle's power by it muzzle energy. The .223 Remington used in an AR-15 has a muzzle energy of
1282 ft-lbs - surely nothing to scoff at. However, in application, this round is used for long-range varmint round for finicky pests such a groundhogs, or coyotes and sometimes for small deer and antelope. I'll leave it to your imagination as to why the military would select a varmint gun for national defense

Prior to using the M16 rifle (the military's fully automatic version of the AR-15), the M-14 rifle was used. This rifle, using the .308 Winchester ammunition has a muzzle energy of 2648 ft pounds - more than twice that of the .223 remington used in the evil assault rifles. The .308 bullet is over three times as large as the .223 Remington.

Prior to the M-14 rifle, the M-1 Garand was used. This rifle used the 30-06 Springfield round, with a muzzle energy of 2820 ft-lbs, even more than the .308 winchester.
The military's current extended range rifle is the .50BMG (Browning Machine Gun). This bullet is is 12 times the size of the .223 remington and has a muzzle energy of  12,000 ft-lbs - ten times more powerful than the .223!

4. Gun Show Loophole

This is a state issue, so I can only comment on the state where I reside. The claim is that if you buy a gun at a gun show you do not need to submit to a background check. This is absolutely false. Any gun purchased from a vendor at a gun show is subject to a background check. The "loophole" has to do with private transactions between citizens. Private sales between two parties within the state are legal without a background check, as long as the seller believes the buyer to be legally able to possess a gun (they think they would pass a background check). It is no different at a gun show. A private citizen may buy from a private citizen if he thinks he is in good standing.

5. Bullet Button
The current draft of Senator Fienstein's Assault weapons ban addresses "bullet buttons" used to work around Californias gun laws. This ban involved semi-atuomatic guns with detachable magazines have two military characteristics. This would have effectively banned AR-15 rifles except for the langauge used to define a detachable magazine as being one that could be removed without the use of a tool.
The bullet button is a device that citizens installed on their "Assault Weapons" which made it necessary for a tool to be used to detach the magazine. This made it a non-detachable magazine and therefore it was no longer an assault weapon.It is usually a cover installed over the magazine release that kept it from be operated by hand. It is called a bullet button because, for some firearms, the magazine release could be depressed with the tip of a bullet, such as the .223 Remington. Keep in mind that the ban specifically named a "bullet" as a tool when defining a detachable magazine.

6. Thumbhole Stock
Senator Feinstein's California ban defined a pistol grip as being a "military characteristic." The creativity of law-abiding citizens who wanted to keep shooting their rifle of choice removed one of the charateristics by combining the stock and pistol grip into a single stock with a "thumbhole" that gave it pistol-grip-like functionality.

Mythbuster: A THUMBHOLE STOCK WAS LEGAL. AGAIN, IT WAS A FAILURE OF DIANNE FIENSTIEN'S CALIFORNIA GUN BAN BEING TOO SPECIFIC (AND SHE IS NOT HAPPY ABOUT IT). SHE CORRECTED THIS IN AN UPDATE TO THE BAN, SPECIFICALLY MENTIONING THUMBHOLE STOCKS.

7. "Cop killer" Bullets

The media would have us believe that "cop killer" bullets are specially made by criminals to kill cops. In fact, the opposite is true. "Cop Killer" bullets are bullets used by the cops to kill people. Ammunition manufacturers do not sell these to the public or to dealers who have not provided a legal statement indicating that they will not sell the bullets to the public.

These are usually more powerful variants of "hollow point" bullets that are used by citizens for self-defense.

8. An ordinary citizen has no need for an "Assault Weapon"

Statistically, this is mostly true. There will rarely be an event that would warrant the use defensive of an "assault weapon" ... UNLESS YOU ARE UNDER ASSAULT!
